1. SMS Program

Our SMS program sends service-related messages such as replies, appointment and lead notifications, and requested follow-ups on behalf of the business you contacted or signed up with. This is a two-way, conversational program.

Consent: You opt in via a form, consent checkbox, keyword, reply, or by providing your number to the business. Consent is not a condition of any purchase.
Message frequency varies based on your interactions.
Cost: Message and data rates may apply, per your mobile carrier plan.

2. Opt-Out & Help

Reply STOP to any message to unsubscribe at any time; you will receive one confirmation and no further messages. Reply HELP for assistance, or contact us at [email protected].

3. Carriers

Supported carriers are not liable for delayed or undelivered messages. Message delivery is subject to carrier and network conditions outside our control.

4. Acceptable Use

You agree not to use our services unlawfully, to send unsolicited or infringing content, or to interfere with or attempt to gain unauthorized access to our systems.

5. Intellectual Property

The website, services, software, and content are owned by DontMiss & Company LLC or its licensors and are protected by applicable laws. No rights are granted except as expressly stated.

6. Disclaimers

The services are provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted or error-free operation, or any particular results.

7. Limitation of Liability

To the maximum extent permitted by law, DontMiss & Company LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or lost profits or revenues, arising from or related to your use of the services. Our total liability for any claim will not exceed the amounts you paid us for the services in the three (3) months preceding the claim.

You agree to indemnify and hold harmless DontMiss & Company LLC from claims arising out of your misuse of the services or violation of these Terms or applicable law.

We may update these Terms; the "Last updated" date reflects the latest revision. Continued use after changes constitutes acceptance.

These Terms are governed by the laws of the State in which DontMiss & Company LLC is organized, without regard to conflict-of-laws rules.
